The charge against Frank Morris of killing the racehorse Ferniemount ended somewhat dramatically when the magistrate said that as the evidence showed a civil action was pending in the Supreme Court, the subject matter of which bore on the present proceedings, he thought ho was in duty hound to discharge Morris. The police prosecutor gave formal notice of appeal.
