"4 APPLICATION BY FAMILY. “FAMILY DONE INJUSTICE.” In a claim under the Family Protection Act that they had not been adequately provided for under the will of the late James Ure Murray, retired farmer, of Eltham, his widow, Mrs. Agnes Murray (Eltnam), and, children, Mrs. Ethel Robertson (W-aipatoa), Mrs Isabel McAlpine (Auckland) and Alfred D. Murray (Eketahuna) proceeded against the China Inland Mission, Dr. John Kirk (London) andi Miss Eunice Bissett (Auckland) in the New; Plymouth Supreme Court yesterday)* Mr. Justice Adams was on the Bench. Mr. A. K. North appeared for the plaintiffs. Mr. D. G. Smart for the mission and Miss Bissett and as attorney for Dr. Kirk. Mr. North said that the application concerned the will of an elderly man who wanted to do something for charitable and religious causes, and for ifersons who had devoted their lives to those causes. Unfortunately, ip the carrying out of this desire members of the family felt they had suffered. The will gave the China Inland Mission £I6OO, Miss Bissett £424 and Dr, Kirk £424. These three had, since .the will was proved, readily agreed each to forego one-third of their interests, the total amount thus obtained to be divided in the proportion, of one-third to the widow and two-thirds to he divided equally among the three children. Mr.' Smart agreed to this. The residuary legatees had gone carefully into the circumstances of the plaintiffs he said, and were satisfied that the dead man, on account of his great age, had unwittingly done his family an injustice. TTn’s* Honour made an order in the terms agreed upon, costs to be taxed by the registrar and paid out of the estate.
