SALE OF ENGINE,
CLAIM SUCCEEDS. Before, 31r J. H. Salmon, S.M., at, the Hawera Magistrate’® Court, this morning, Harry Barratt, of Hawera, fit ter, proceeded against Alfred Henry Sorenson, of Oaonui, carpenter, claim ing the sum of £9 as the agreed price of a petrol engine allegedly sold to defendant.
Mr L. A. Taylor appeared for plaintiff, while defendant conducted his own case.
In evidence, plaintiff stated that de--1 fondant, who had 'been hiring the engine, had agreed to buy it and had agreed to pay £9, the purchase price, on February I last. The money had not been foidhcoming on that date, and subsequently, when defendant had no further use for the engine, it had been agreed that defendant should pay plaintiff for its use and then put it in an auction mart.
Defendant maintained that he had carried out this larrangomcnt and had relieved himself of liabilitv.
His Worship held that the terms of settlement had failed land gave judgment for the amount •claimed, less £1 5s paid by defendant.
