The Dominion Trust Company of New Zealand, Ltd., J. 0. Jamieson, company manager, and G. G. AlcKellar, accountant and shareholder, proceeded against. James Stephen Day, public .accountant, in the Supreme Court at Ohiriistehure.h yesterday, for £SOO alleged to be due to the estate of the late Richard Heyward, farmer. It. wa.- ai'ieged that in December, 1927, Day, as syndic for the company, obtained fetters of administration of Heyward’s estate. In August, 1928, Day was discharged front the position of administrator .and Jamieson and AleKef lar were, appointed. Day sold certain bonds), .belonging to Heyward, without paying the money received, £SOO. Day alleged that he sold the bonds on Heyward’s instructions, that Heyward lent him the money, that he gave lEeyward l a promissory note for the sum and that Heyward destroyed the. note, making a present of the £SOO to D ay. Air. Justice Adanns said he was not satisfied that Day’s story was proved. It had left on his mind) a strong impression that no. such arrangement had been made.
