MAGISTRATE’S COURT.

•MOTORIST’S LICENSE CANCELLED. Following the instructions of the Magistrate at the Court this morning, that Brian Douglas Nicholas (who was a witness in .a case), be also- charged, with negligent riding of a motor cycle, the latter appeared voluntarily and pleaded guilty to the chaTge. His Worship isaid he was pleased that defendant had saved the necessity of a summons being issued, and taking into consideration defendant’s .youth and position he would be convicted and ordered to pay 3s court costs, Ms license to be cancelled until May 1, 1928<‘ WHAT ARE LICENSED PREMISES? On the information of Sergeant Henry, a charge of employing a barman under the age of 21 years was preferred against Edward Cann. licensee of the Commercial Hotel, Hawera. The sergeant of police stated that the defendant nad employed Noel Cann, a person under the age of 21 years, in the bar at the racecourse during the recent Eg man t Racing Club’s meeting', thereby committing a breach, of the Licensing Act, 1914, section 10. Sergeant Henry, prosecuting, stated that he had known defendant for the past eight years, and stated that he had always complied with the-law- in every respect. On the day in question, February 2, witness visited the booths at the racecourse and saw defendant’s two sons, both under the age of 21, in the booths under the stand. He pointed out to defendant that he was liable to prosecution, but Cann said he would take the consequences. Witness suggested that there was no evidence to”show that the youths were selling liquor; they were only taking change at the time' the charge was made. Considerable legal argument ensued •is to what constituted licensed premises. and Mr. Ryan, for the defendant, contended-that no breach of the Licensing Act had been made. His Worship dismissed the information and intimated that he would give Ms judgment in writing.
