DISPUTE SUBMITTED TO COURT

Reserved judgment has braen delivered oy Mr J ustice Herdman .an the petition presented at the last session of the Supreme Court at Hamilton, when th? removal of one of the trustees of the fund of £IO,OOO donated by the late Herbert Snivt-h. of Hamilton, for sivecific purposes was sought. He died on July 13. 1936, leaving an estate valued at about £140,000, but the provision of the will relating to the establishment of the trust had been inoperative owing to the failure of the trustees to agree on the manner of its administration in his will. The deceased set aside £IO,OOO to provide for athletic competitions to the youth of New Zealand between the ages of nine and fifteen. He appointed the petition'd ■ (Mr O. B. Smith) and a lifelong friend, Mr F. A, de la Mare, to be trustees and administer the fund. They failed to agree on the linterpreta-t-ion of his full wishes and concurred that the matter should be presented to the Court to decide which one ot them should he relieved of the office. After considering the matter, Mr Justice Herdman has directed that Mr F. A. de la Mare should retire from office of trustee. He will appoint another from the names submitted by the remaining trustee.
