AFTERMATH OF A COLLISION

The case in the Supreme Court today liefore Mr Justice Alpers, when David Simpson, of Lower Hutt, machinist, and his wife, Mahel Simpson, claimed damages totalling £1065 12s 6d in respect of the latter’s injuries, due to the alleged negligence of a driver of a motor vehicle, owned by Magnus Motors, Ltd. (the defendants), was adjourned to to-morrow, when the case for the defendants will conclude Plaintiffs’ statement was that Mabel Simpson was riding a bicycle on the Hutt road on November 28, when a car driven by Frank Dickinson, an employee of Magnus Motors, collided with her, and she received severe injuries, including the permanent loss of her sense of smell. In regard to the count of negligence, plaintiffs claimed that the driver of the defendant company’s motor vehicle was travelling at an excessive speed He did not try to avoid plaintiff, althomrh there was' plentv of room, while the motor vehicle was not under proper control. Though plaintiff’s bicycle was close to the edge of the bitumen, only about- one foot away from it, she was struck by the defendant company’s motor vehicle, despite the fact that there was plenty of worn for the driver to avoid an accident. The defence was an absolute denial of the plaintiffs’ allegations of netrlioienoe, the accident itself,, however, being admitted.
