MOTOR DRIVER’S APPEAL

' (BY TELEGRAPH —PRESS ASSOCIATION.) AUCKLAND, Sept. 3.

An appeal by Joseph- Mercer from a sentence of one month’s imprisonment imposed) by Mr Hunt, S.M., for negligent driving which- resulted' in the death of one' passenger and! injuries, to two others near Papakura on January 22, was heard by Mr Justice Herdmnn at'the Supreme Court.. His Honour refused the application to substitute a fine for imprisonment, hut. reduced the sentence to 10 days. He was particularly impressed by. the evidence of the appellant’s employer as to Mercer’s good character and to the evidence- that he was perfectly sober.
