CLAIM. AG AINST .RATEA COUNTY COUNCIL.

A claim for £350 as compensation for alleged inconvenience caused as a result of the widening'and deepening of the Ball Road at tin*':-Alton gorge was this morning opened beforei the Assessment Court at Hawera. Mr. J. S*. Barton, S.M. , associated with him as assessors were Messrs. P. G a with and J. R*. Corrigan. The c-Him-a.nt was Charles Amon of Alton lor whom Air. F. O’Dea. appeared, and the respondent-was thePatea' County Council, 'represented by Mr. D. G. Smart. The claimant alleged that as a result of the deviation and deepening of the road opposite his property, of winch he was the absolute -owner-,’ the access to his house and garage taken away, and he had great difficulty and danger in obtaining access .to these buildings. It- was impossibly to use the garage at all, and the house could only, be -reached by use- 'bf, a 14 foot ladder. The claimant’s lon-y had -in consequence of the deviation been exposed to all weathers for a year owing to the fact it could not be garaged. The claim of £350 was made up as follows:. Depreciation in. the value ol the house and garage and lorry owing to difficulty or impossibility of' access, £3OO for house, £25 for garage and £25 for lorry. . , 'V The claim, had originally been' filed in the Supreme Court tat New Plymouth, but by arrangement with the judge, and the respective counsel, it had been referred to the Assessment Court, Air. J. S’. Barrton, S.M., Being nominated as president. The claim was opened and adjourned until 1 noon for the purpose of allowing the Court to* visit the property. Mr. O’Dea stated that formalities had been complied with, but Mr. Smart would raise a formal objection •that the claim -had -not been lodged within one year of the completion of the work which caused the .inconvenience. * The defence, was a direct denial.
