ACTION AGAINST NEWSPAPERS. APPEAL COURT’S DECISION. (BY TELEGRAPH —-PRESS ASSOCIATION.) WELLINGTON, Oct; 23. The Appeal Court gave judgment today in the alleged contempt of Court cases against the Christchurch Sun and the Christchurch Star (heard on October 16). The ease against the latter was unanimously dismissed, on the ground that the paper merely reported what actually took place in court, and such report was privileged. In the case of the Sun the Court was divided. Sir Robert Stout (Chief Justice) and Judge Ostler held that the charge should be dismissed, while Judges Reed, Sim, and Adams were of the opinion . that the paragraph contained an obvious comment that the witness was biassed against the prisoner. As counsel had expresed regret, the ease would be met by the payment of costs' amounting to 15 guineas and disbursements. No costs were allowed in the Star case. (The- actions arose out of statements contained in the Sun’s report of the Mouat trial.)
