ALLEGED VALUELESS CHEQUE.
ATTEMPT THAT FAILED. PROBATION FOR ACCUSED. Walter Kendal] was charged at the Magistrate’s Court to-day with issuing a value les cheque and attempting to purchase £5 worth, of goods and obtain £lo cash by means of a cheque for £2O. The case, as outlined by Sergeant Henry, was briefly that on July 31 accused asked Mr Faulkiner, of the Egmont Hotel, for a blank cheque, stating that he had an account with the Bank of New South Wales. Later that day Messrs Purser and Suisted had complained that a man had bought from their shop £o worth of linoleums. He had tendered a cheque for £2O, and their employee had taken the cheque to the cashier. Meanwhile the man had quietly left the shop. About threequarters of an hour later accused was arrested by Constable Tocker for drunkeness.
Constable Tocker supported Sergeant Henry’s statement, and said that when he interviewed accused with reference to the valueless cheque charge he had made a statement denying all knowledge of issuing the cheque on account of being drunk. Accused pleaded guilty, and elected to be dealt with summarily.
The magistrate, Mr J. S. Barton, S.M., said that the ca-se looked as if it had emananted from drunkenness. There was a possibility that accused would not have committed the offence had he been, sober, but there was also the chance that he might have been more successful in a sober condition Under the circumstances accused would be admitted to probation for tw-o years, i special condition being imposed that accused should take out a- prohibition order for the term of his probation.
