ESTATE DUTY CLAIM.
ADMINISTRATOR’S AWKWARD [POSITION.
FROM OUR PARLIAMENTARY REFORTER. WELLINGTON, July 30. A petition has been presented by Mr O. Hawken (Egmont) from Michael Leydon, farmer, of Hawera, praying for a return of £67 which, as> administrator of the estate of Jas. Leydon, deceased, he was obliged to pay on the demand of the Commissioner of Taxes, being 6 per cent, on the death duty which became payable from the date of the death of Jas. Leydon, until the petitioner paid estate and succession duties amounting to £642. It was, pointed out that one will had to be contested, and that the Supreme Court, in an action lasting several days, declared that it was void. Petitioner was then granted letters of administration, hut until this had been done he was powerless to do anything in connection with the estate. He contends that, under these circumstances, the charging of additional interest is inequitable, as he carried out his duty as administrator in a prompt and efficient, manner immediately he was entitled to act.
