ALLEGED WASTE TIME.

A CARPENTER’S CLAIM. AGAINST OPUNAKE BUILDER. A case in which a carpenter claimed £'2l Bs. 'from a builder £l6 10s. of the claim being for alleged waste of time, occupied the. greater portion of the time given to business, at the Hawera Magistrate’s Court yesterday. The plaintiff, W. C. A. Worsup, was represented by Mr. H. L. Spratt, and the defendant, W. H. J ones, by Mr. H. B. Gibson. ' At the outset it was stated that £4 18s. representing wages and travelling expenses due to plaintiff, had been paid prior ta the serving of the summons, and therefore the balance of the claim stood at £l6 10s. Plaintiff in his evidence, said that in September he received a telegram from Jones offering him work at the R-ahotu factory at 3s. per hour. He went out to the ,job and after doing this and other work he estimated that lie had wasted 11 days, at 30s. a day, owing to defendant’s absence and failure to supply material. For the defence it was denied that the relationship of the two parties during the period that the tile was alleged to have been wasted, as that of employer and employee, and it Was stated that if there was lost time plaintiff could not expect to be paid for it. It was no fault of Jones’ if time were wasted. The ease was adjourned for the hearing of further evidence at the Opunake court at a near date to be fixed.
