UNUSUAL INCIDENT.
IN CRIMINAL PROSECUTION.

An unusual and unprecedented incident occurred at the Cardiff Assizes, where a man previously discharged at the petty sessions on a charge of maliciously setting fire to a house was presented on a similar charge. Mr. Justice McKinnon overruled counsel’s objection that the charge could not be preferred, and ordered the hearing to proceed because the Grand Jury had found a true bill, but no one was present to prosecute. The judge said he would have to examine the witnesses, and suggested that some member of the Bar should take depositions for the purpose of assisting him, but no one responded. The iudge then began the task himself, but later the Bar agreed to assist and the hearing proceeded.
