t AGAINST COMPANY’S LIQUIDATOR,

PLAINTIFF NONSUITED

A claim for £lB wages, by C.has. Blake against Hugh Blake Burdeian, as liquidator of the General Transport Co. 1 , was „made in'the Hawera Magistrate’s Court 'this morning." Mr Matthews appeared for the plaintiff, arid Mr Bay lev for the defendant. Mr Matthews said that' at the' end of the company went. into liquidation, and the debenture holders put in a receiver. Defendant was the receiver for the debenture holders, and he" was the liquidator for the liquidation.

Plaintiff, who. is a motor, mechanic, said he was being paid £6 per week. There was a fortnight’s work .for which he had receive# no pay, and as he had received no prior notice to quit, he was claiming a further week’s wages in lieu of notice. He had left for. Palmerston North on a Friday night, his fortnight’s wages being due on. the day following. He returned to Hawera oil the Holiday night following, and on going to work the next day the man-' ager (Williams) told him that the, company had gone into liquidation and his services would not be - required any further. A\ illiams informed witness l that he could not pay him his wages', l and told him that 'Burdekin had mat-' ■ tors in hand. On interviewing Burde-’ kin, however, witness was told that he ' con Id not be paid. .Later he was told .that it had been necessary to pay the ’bus drivers’ wages in order to "carry on the business. On. returning to 'Williams, witness was told that he (Wil-. liaiiis) had'liad instructions some time previously that he- was iiot to pay the wages due for the previous fortnight. Witness.' however, had received hiswages for that fortnight. Crqqs-ex a mined liv'Mr .Bavley, witness said ,he received £l2 in wages and £lO 7s overtime, making his wages paid up to September 13. He worked until the 27.t1i, when he left .for Palmerston Norljli, and received his notice on the’ Tuesday following. He was away, from' work a day and a lnilf. Wilinont Boyce, contractor, said he was ‘ employed by the General Transport Co. prior to their going into liquidation. He also had a fortnight’s wages not paid to him, and on seeing Burdekin witness had been told that he did not think there -would be any .funds to pay .wages, and if he wanted to go any further he would have to come in as an ordinary creditor. Hr Bavley asked for a nonsuit, and contended that the present court had no jurisdiction, as the action should have bqen brought in the Supreme Court.

Plaintiff was nonsuited, with costs and solicitor’s fees £2 2s.
