MAGISTRATE’S COURT.
The weekly sitting of the Hawera Magistrate’s Court was continued yesterday afternoon. BY DEFAULT.
Judgment for the plaintiff, with costs against the defendant, was- given in each of the following undefended civil cases: B. R. Long v. E. Hill, £4 15s; same v. L. Coe, £3 ss; same v. H. Rolls, costs only; E. B. Shaw v. J. Barnes, £72. JUDGMENT SUMMONS. In the judgment summons case of the D.O.A. in the estate of J. W. Turnbull v. Tommy Tutawa, an order )vas made for the payment of £B2 16s, m default 86 days’ imprisonment. CLAIM FOR COMMISSION. A. Hatrick and Co., Ltd., claimed from H. H. Moller the sum of £7O, being moneys allegedly wrongfully retained by defendant. Defendant on the other hand counter-claimed for the sum of £7O, being commission which he held was due to him, or in the alternative £7O due for services rendered.
Mr Matthews, for defendant, said that Moller was a motor salesman employed by Hatrick and Co., he being authorised to' collect purchase money on the company’s behalf. In pursuance of these instructions he collected £l6O from one Warren, of Hawera, and as there was money owing to Moller by Hatrick he kept back £7O and forwarded the balance on. The plaintiff company, on the other hand, W'ere owed a considerable amount by Messrs Blake and Sons, of Hawera, whose financial position was unsound, and contending that Moller was employed by the Hawera firm they had credited Messrs Blake and Sons with the commission and had left Moller out in the cold.
The evidence of the defendant Moller was taken, but when the court adjourned Mr O’Dea, for the plaintiff company, had not opened his case.
