SIMPSON TRIAL.
MISCARRIAGE 01' JUSTICE. BY CABLE—PRESS ASSOCIATION —COPY BIGHT SYDNEY, July 1. Simpson’s new trial was granted on the grounds of the wrongful admission of evidence. Counsel for pointed' out that there was no direct evidence of firing the fatal shots, and reliance was placed by the Crown on a statement by Clift, one of'the victims of the shooting. Owing to a. flaw in the proceedings the ordinary dying depositions could not be made use of, and the Crown sought to take advantage of what was said by Clift in giving his dying depositions as if it was a statement made in the presence of accused. He contended that the law could not accept such statements a® actual evidence aginst the accused. The Chief Justice pronounced that it amounted to a miscarriage of justice and ordered a new trial.— Aus.-N.z’ Gable Assn.
