At a- sitting of the court in banco John White secured a verdict for £540 against the Davis Gelatine Company of Australasia, Ltd., for an alleged breach of the charter party. Plaintiff, who claimed £3500 as damages, stated that it was agreed by the charter- party that the defendant’s ship the H-. K. Hall, then at Lyttelton, should proceed to Malden Island to load a cargo of guano, which was to be taken to New Zealand and delivered on the payment of the freight. The allegation was that the defendant failed to carry out the agreement. The defendant party pleaded that it did not agree as alleged, and was prevented from carrying out the agreement Jjv the dangers and perils of the sea. A stay of proceedings was granted.
