Hastings M.S. Court

Wednesday, Oct. 13. A CHARGE OF MURDER At the S.M. Court this morning before Messrs Eliis and Beilby J.P.'s, Thomas M'Phail was charged that he did on the night of October 4th last murder one Harry Susan. Constable Smith conducted the case for the prosecution. Mr Lee appeared for the accused. The evidence was mainly a repetition of that given at the inquest, a full report of which appeared in these columns. Up to the dinner adjournment the witnesses examined were John Gardiner, Dr Linney, and C. H. Shattky. Cross - examined by Mr Lee Dr Linney stated that a fall upon an asphalt pavement from his own height would not fracture an ordinary skull in the way he found that of deceased. In the afternoon William Egan (a shearer) and Constable O'Brien were examined, nothing new being elicited. (Left sitting.)
