An Important Decision by the S.M.
In the case Loughnan and others v. Hatton —an action for recovery of rent under an agreement to lease —Mr Turnbull, S.M., gave judgment this day. Mr A, J. "White appeared for the plaintiffs and Mr A. C. Lewis for defendant. The question for decision was whether an agreement to lease for more than a year took effect as a lease or whether it operated as a tenancy, determinable on a month's notice in writing. Mr White quoted cases in support of contention that agreement to lease took effect as a lease and the S.M. upheld the decision and gave judgment for plaintiffs for £36 5s ; costs 80s, and solicitor's fee, ±'2 2s.
