The Tank Question.

In the Appeal Court at Wellington on Tues day, Mr Justice Richmond delivered judgment in the case Maude v. Bourke, an appeal from the decision of the Resident Magistrate at Gif. borne, fining appellant for a breach of the’ orough bye-laws in neglecting to provide water tanks on his premises. His Honor held bat the bye-law was bad as being unreason able in nut providing time afier notice within which householders could erect tanks, etc. He held the object sought by the bye-law was reasonable. The bye-law can therefore be ™ l,datßd amendment. The decision of Mr Booth has therefore been quashed on a point which was not raised at all in the B M. Court. The bye-law reads that “ the owner or occupier of such premises failing to comply with this bye-law after receiving notice from the Inspector shall forfeit a sum not exceeding 20s for each day of such default,” so tnat if the words “ one week from the date of were inserted after the word “ bye-law ” apparently that would be all that would be required to validate the bye-law.
