R.M. Court.
The following business was transacted at the R.M. Court on Thursday, Mr Booth, R.M., presiding:— Judgment was given by default in the following cases : Boylan and Co. v. C. W Ferris, claim Ils 6d ; Miss Doran v. Ferris, claim £9 7s 84 ; Jas East v. G. K Turton, claim £1 ss; Burch v. Direy, claim 7* 61; George Grant v. Thomas Palmer, claim £32 6s Id. J. Brvce Berry v. W. Jaggs, claim £3 Ifig on a judgment summons. An order for payment was made, execution to be extended for seven days; in default four days’ imprisonment. Public Trustee v. W. Jaggs. Ordered to be paid in a fortnight. R. Knox v. S. Stevenson, and J. Wallace. — adjourned to Monday. James East v. Fanny Gathercole, claim £2 4s, amount of a dishonored cheque. The plaintiff deposed that he received a cheque drawn by S. M. Wilson, from the defendant, which was dishonored. He had demanded the money from her several times, but she said she was unable to pay. Miss Gathercole stated that Mr East did not tell her that the cheque had been dishonored until about nine months after the transaction took place. Mr Macdonald, who appeared for the defendant, submitted that no notice had been given of the dishonoring of the cheque. Had the defendant known that the cheque was dishonored she could have proved in Wilson’s estate and received the money, as all Wilson’s servants received their wages out of the estate. Judgment was given for the plaintiff. YESTERDAY. Col villa v. Union Steamship Company claim £25 for loss of a portmanteau. After the evidence of the plaintiff, Mr S. M. Wilson and Mr Dougherty had b?.en taken, the case was adjourned to August 30 to allow of evidence being taken at Napier and Lyttelton, Boylan and Co. v. Isabel Stubbs.—Adjourned to August 30 for legal argument.
