JAMES-MABIN CASE. JUDGE ADAMS ’ DECISION. CHRISTCHURCH, August 24. Judge Adams gave reserved judgment to-day in the case Henry Digby James of Greymouth, printer, versus Edward Ernest Bayley Mabin of Nelson, bank manager, claiming £2500. James alleged fraudulent representation by Mabin to give a guarantee on account of E. J. Rundle and Co., claiming that when Mabin was manager of the Bank of New South Wales at Greymouth, he advised James to enter into a guarantee of the account of E. J. Rundle hud Company, timber mer chants.. In September laift, the bank demanded from James and two other guarantors, payment of £32,000, and to secure the release of liability. James paid the bank £2500. The company was unable to pay that sum to James. Plaintiff alleged that to induce ham to' enter into the guarantee, Mabin fraudulently and falsely represented that the company’s financial position was quite sound. Judge Adams held that th e state ment of claim did not disclose any cause of action., and he awarded costs and disbursements to the defendant. CHRISTCHURCH SENTENCES. CHRISTCHURCH, Augus‘ 24. At the Supreme Court, th.- following prisoners were sentenced:— George Creasey, 56, bigamy and false statement, nine months’ gaol. It was stated that prior .to committing bigamy, Cn a c ey had been imprisoned six times for failure to maintain his; wife at Invercargill. Roland Harold Cole, 32, indecent assault on male, three months’ gaol. Jas. Neil, forgery, two years’ probation. Edward Tarlington Horne, breaking, entering and theft, two years’ reformative detention.
