At a sitting of the compensation Court. Mr. Justice Hosking presiding, the case of the New Plymouth --Borough Council against the Public Works Department for A' 1 1 7.69 compensation for gravel for railway ballast, and co-n---ct)cte. tunnel work taken from a pit on the property of the council, was opened.

Evidence was given that the 'Hepirtnent took the gravel for nine years, then at th« request of the Council took the land by proclamation.

The Department claims that by requesting that the land ho. taken tinder the proclamation Council forfeited tho right to compensation for daroag.e and must confine this claim to the value of the land taken. . The case :.s proceeding.
