RESPONSIBILITY OF STEWARDS.
Auckland, July 15. At the Cambridge Court an interesting case, Brimble v. Buckland and others, was heard, showing the non-responsibility of the stewards and officers for the payment of stakes. Hay appeared for the defendant, and plaintiff claimed £9 10s, the amount of the stakes won at the Piako Turf Club races, on the 30th of November last, by his horse Robert the Devil. Plaintiff stated that he had applied for money to the Secretary of the club, Mr George ! Smith, of Morrinsville, who had said that ! the money should be paid when the race subscriptions were got in. Messrs Buckland, Evans, Turnbull, and Breakall were now summoned as stewards, but all when sworn said that their names were placed on tht list of stewards without their consent and in their absence. Hay quoted authorities to show that even had defendants been proved to be stewards they were not liable, not being stakeholders, and that even a stakeholder himself was personally not liable for stakes until he had himself received possession of money. Judgment was given for defendent, with costs £8 13s.
