WARDEN'S COURT, AHAURA.

; I Friday, .November 22. (Before; Mr Warden Whitefoord.) Arthur Ellis and party v. James Sinclair and party, Michael Ward and party, . Arthur O'Keefe, Patrick Lawlor, and othera.— - These were ■ separate actions for damages for injury done the head-race and reservoir of / the jcbnTplainants at Nelson Creek by running sludge into them; Sinces the summonses :were:taken out in these cases the Warden had visited the scene of .the. dispute, at Try-Again terrace. An equitable arrangement was made, and the complainants now withdrew their complaints.; The cases . were dismissed. The comnlainan+s applied for costs, as, agaißst Ward and.party.^ The rest ? of -.; the defendants were, willing 1 ! to .contribute -.their proportionate ■shares^ of 'the •; expense^.^ -The ;War:len declined'to make any order m : the absence;6'f"defendants, Ward and party.-- In conoequence of the matter having been settled by arrangement, Ward ; and party, might not be aware of the intention of the complainants to. make the application. . He . would suggest that each of the defendant's parties should pay the complainants Ll to reimburse them for the expense incurred by them. The complainants were"'satisfied with- this and the defendants who were present, agreed, to the proposition, Eric Bostedt applied f or 'a. frontage tunneling area at the Teviot.— Opposed by Thomas Doyle .and party, on. : the ground that the applicant wanted to lay off his parallels an contravention of .the recognised base line; tAfter takingi.eyidence; the 'Warden granted the area . subject to its being marked off in accordance with , the boundary lines of the prospector's claim.' - : . Granted. , Application, for. certificate of ..- registration for tramways,- darns, and tunnels, made by the same parties, were also granted. ■ -^ Certificates of registration -for tunnels wera ; granted to Thomas Fagan, a'tithe Teviot, and James Greenway, at Sullivari I J| Creek, Ahaura. -' :; ' - An agreement in writing was presented to the Court, signed by- the several parties to the dispute about the sludge nuisY ance at Try- Again Terrace, Nelson Creek, stating that they, would contribute irrprbportion to their liability towards the construction of a main sludge channel for the general benefit, as proposed by the Warden. The Warden directed the document to be filed in Court and confirmed the agreement, remarking that he was pleased tp see threatened, serious, and expensive litigation avoided, in such an equitable and amicable manner. .The Court adjourned to November 29.
