Friday, November 29. , ' (Before C. Whitefoord, Esq., RiM.); : - The following cases were disposed of :— H. Wick v. J. G. Heslop, a claim of LlO on an • IOU. [ The defendant did not appear. The plaintiff, 'oh being sworn, stated the case had .been postponed on two former occasions, in consequence of the non-service of the summons;' He had since the last Court day seen the defendant at. Greymoiith, who told him that a person named ' Montgomery • would settle the account, or a portion -of it, which, had. not been done.;- The defendant then told- .him- he would attend to defend the action, but he: was now informed he went to x Hokitika. The defendant also, told him that if . he (the ; "plaintiff) pressed , for payment, he ' (the defendant) would file his schedule. . .The' Magistrate said that, as' it appeared,' the: defendant was attempting to evade settlement of a just debt, a verdict would be for the amount claimed, with LI 13s costs and LI expenses to the plaintiff. Under the circumstances a warrant, for immediate execution would be issued ■ but if the defendant came at onc£ to the Court, and \ applied, Rafter showing goodi cauje, for a rehearing of the case, it would be granted to him. r -,Tudgmentfor the plaintiffs with costs, were given in— Hamilton (Greek) v. Fitzgerald, L 3 4s 9d;' bame vC. Ainsley.LS 0s 9d ; White and G *r fc £ v - F - Grogan, L 8 7s 6d ; Stewart and Burrows v. Ainsley, L 4 6s 3d. The Court was , adjourned to the-3rd December. , ■ ■
