MU G. H. LYSNAR’S AGREE- ‘ MENT WITH BOARD. IT VALID AND BINDING? “fe, IF AS CONTEMPLATED. ’ ’ WELLINGTON, Oct. 7 yj r Justice Reed gave judgment today m the ease Gisborne Harbour Board v. George Henry Lysnar. The case was to decide the liability of the Beard under an agreement to pay Lysnar one per cent, on the harbour scheme proposed by him. The &X -Court deoided that the. agreement r W as valid and binding on the Board and subject to Lysnar’s scheme'being such as the agreement contemplated, he would be entitled to one per cent., which was estimated at *15,000. —P.A. Yesterday Mr H. A. Barton, secretary of the Harbor Board,' received advice from th'e Board's solicitors, Messers Cbrisp and Chrisp, that in the action Gisborne Harbor Board v. G. Lysnar, judgment had been delivered by His Honor Mr Justiee Reed in Wellington. His Honor, at the conclusion' of the judgment, states that he assumes the Board will lodge an appeal.
