MR. BRAUND’S ATTACK,

In giving a decision on Victor Braund’s personal application re the Colonial Bank books, Judge Edwards, on beba'f of himself and Judge Gocper, concluded : " Thus, oven if wo had jurisdiction upon the applicant’s motion to disturb the erder made by Judge Williams for destruction of the books and papers of the Bat k, applicant has not, in our opinion, shown sufficient cause for doiDg e", ioaemuch as he failed ta show us that the production of the berks is neoessary for tbe purposes of the action be baa beguD, and ha 3 failed satisfactorily to account for delay in the prooeedngs la our opinion, therefore, the order in Chambers dismissing applicant’s motion was rightly made, both upon this ground and upon the ground that applicant has do Btatus to intervene, Ws there fore dismiss tho motion, with seveo guineas Co3t=,”

tion, Mr F.aser, advisor of the liquidator, said he would consider this, and accept the Coutt’s permission to say to-morrow mo rniDg whether or not ho would apply,
