APPEAL COURT.

Wellington, last night. The Appeal Court was occupied to-day with the case of Kiddilord v. Warren and others, an appeal from the decision of the Chief Justice. Respondents, who are sheep-farmers at Pahiatua, contracted to sell all their lambs for the season to appellant, hut repudiated the agreement on the ground of misrepresentation by appellants. The agents of the latter brought a suit for A'2.70 damages, and the Chief Justice held their had been misrepresentation, though innocent, entitling respondents to rescind the contract. The appeal involves consideration of the present condition of the law in regard to the effect of innocent misrepresentation on contracts of sale or purchase. Argument for the appellant in the ease of ltiddiford v. Warren was concluded in the Court of Appeal this afternoon. Argument for respondents will he taken tomorrow morning.
