LICENSING CASES.
BREWERS’ AGENT FINED,
By Telegraph—Per Press Association, Dunedin, last night.
At Clinton to-day Mr Stratford, S.M., gave his decision in the case in which the police proceeded against John Hay, under the Licensing Act, for receiving orders in the Clutha Licensing District, where prohibition prevails.
The Magistrate decided that had the proprietors of the brewery received the order within the district they would have been liable, so likewise was their agent, the defendant, who received the order for beer on their behalf. A very narrow lino was drawn between the legal and the illegal ordering of the beer for private use. He therefore only imposed a fine of £5, with costs,
Defendant pleaded guilty to three other charges, and was ordered to come up for sentence when called upon, punishment for a second conviction being imprison - ment without the option of a line.
