LILLYWHITE OR BLATCH ?
FINE POINTS TO BE DECIDED
[By Telegraph—Press Association.] Wellington, last night. The Supreme Court delivered its judgment on Saturday afternoon in tho case in which Mr Skerratt applied to the Court to make an absolute rule nisi of liapeas corpus in the ease of Charles Lillywhite, whose extradition is sought as Arthur Blntch, charged with the murder of Alfred Welch, at Colchester, England, on tho Bth December, 1893. The Chief Justice said the Court was agreed as to tho first point raised, viz., that tho depositions taken at the coroner’s inquost on the murdered man Welch wero admissablc before tho Magistrate's Court. As to the second point, with regard to tho functions the Supreme Court should exercise, tho Judges did not agree. That being so, their decision was that the case should bo rc-argncd before tho Supremo Court on the 18th March. Mr Skerratt, counsel for accused, said it was probable that-his client would prefer to be sent Home, provided arrangements could ho made for sending him via British Columbia, bo that he could bo identified at Takoma (Washington State, U.S.A.), whore lie had lived as Lillywhite. After discussion it was agreed that as tho Chiof Justice has to go to Auckland to-morrow, the prisoner should stato his decision whether he would go Home or have tho case rc-argucd to Justico Edwards next week.
