CHARGE OF DRIVING WITHOUT CARE AND ATTENTION DISMISSED
Following the hearing of evidence, a charge against Edward Ernest Harvey, Whakarau (Mr. L. T. Burnard). that on December 17, 1948, in Crawford road he drove a car without due care and attention, was dismissed by Mr. E. L. Walton, S.M., in the Magistrate’s Court at Gisborne yesterday. Evidence as to the collision was given by a taxi-driver, Reginald Edmond Gregory, and a passenger in the taxi, Jack Maki. Constable" G. Neal produced a statement in which Harvey contended that he had put his hand out before turning. The other two witnesses stated that Harvey had not put his hand out. Stating that the first two witnesses did not agree in all particulars and that he was satisfied that the accident did not happen in the way which the evidence indicated. Mr. Walton dismissed the charge, after Mr. Burnard had submitted that there was no case to answer. Senior-Sergeant G. S. Norris prosecuted.
