AWARD OF £BOO
CLAIM ON ESTATE (P.A.) WELLINGTON, Dec. 11. “I indicated when the case was heard on Friday that some arrangement might be made between those concerned in the proceedings and I had an adjournment in that hope,” said the Chief Justice, Mr. Justice O'Leary, in the Supreme Court in giving his decision under the Family Protection Act, 1908. in the case where Cyril John Smith, of Wellington, builder applied for a share in the estate of his mother, the late Mrs. Annie Smith, the defen dants being a sister Mrs.Carcli r; a Huia Tonkin, and the Public Trustee. In reply to an application of the first defendant for an adjournment on the ground that the plaintiff was not supporting two children of a first marriage as had been indicated in the previous evidence, the Chief Justice said that it was not a circumstance which he would take into account, and it was too late. Whether or not the plaintiff was supporting the children would not affect the order. “This is not a maintenance he added. The Chief Justice said he would make an order on the evidence in front of him. He added that he thought the mother had failed in her duty to he r son particul irly as a considerable part ol her esmte came from her husband, and ne ordered payment to the defendant of £BOO clear of all duties from the estate.
