TEST OF VALIDITY

AIR NATIONALISATION RESTRAINT WRIT ISSUED (9 am.) MELBOURNE, Sept. 23. The first step to test the validity of the Commonwealth’s air nationalisation legislation has been taken. On behalf of Australian National Airways Proprietary Limited a writ issued out of the High Court claimed an injunction to restrain the Commonwealth from interfering with the company’s operation of any of its airline services on the ground of any airline license having become inoperative by reason of the purported operation of the Australian National Airlines Act. The writ has been issued against the Commonwealth Treasurer, Mr. J. B. Chifley, the Minister for Air and Civil Aviation, Mr. A. S. Drakeford, and the Director-General for Civil Aviation, Mr, McVey.

The plantifif claims, among other things, a declaration that the Australian National Airlines Act is beyond the powers of the Commonwealth and is void because it is contrary to the provisions of the constitution.
