Mr. Justice Smith has dismissed the appeal of Henry Sefton Herbert, of Hawera, against a conviction for taking part in the activities of a subversive organisation, Jehovah's Witnesses

.The main ground of the appeal was that the regulation under which Herbert, was convicted was ultra vires and, void, but His Honour held that the regulation was plainly valid and that the delegation of, discretionary authority to the Attorney-General was expressly authorised. _____
