APPEAL ALLOWED
TRAFFIC LICENSE CASE EAST COAST TRANSPORT An appeal against a conviction in the Magistrate’s Court was allowed by Mr. Justice Blair in the Supreme Court yesterday, when the East Coast Transport, Limited (Mr. G. J. Jeune) appealed against a decision on action taken by Robert Metcalfe, Main Highways Board traffic inspector (Mr. F. W. Nolan). In the Magistrate's Court the company was fined £6 and costs. Mr. Nolan said that the company had a general goods license between Gisborne and Matakaoa County. Under that general license the appellants could make four trips ip. a month with each of two vehicles, so long as it did not cart metal. Tire company had also a special license under which it was able to carry goods only for the Native Department. The company was charged with carrying goods other than for the Native Department when travelling under a license to carry only for the department. The defendant had admitted that the trip concerned was a Native Department trip. His Honour: But could he not change his mind? He might say that he still had general trips to spare. Mr. Jeune said that the trip in question was the first general trip of the month. The company’s truck carried general goods at the time, and the company did not admit it was a Native Department trip. Mr. Nolan said he was prepared to admit that the company had not used up all its general trips, and in view of His Honour’s statement he would not press the appeal any further. The appeal was allowed without costs.
