PLAYLAND DISPUTE

GAME OPERATOR SUED COUNTER CLAIM FOR £750 (Pur Press Association.) WELLINGTON, this day. One of several claims for possession of stands in Playland at the Centennial Exhibition, and arrears of rent, was brought in the Supreme Court yesterday by Double Grip Tubular Steel Devices, Limited, proprietors of Playland, against Edward Lay, operator of the fishpond game. The defence challenged the right of Henry Seff, general manager and representative of the company in New Zealand, to sue on behalf of the company, and in a counter-claim fraudulent misrepresentation was alleged on the part of Seff in allowing more stands than allegedly had been originally intended. Damages totalling £750 were claimed. Several stallholders gave evidence that when arranging for space they were given to understand by Seff there would be between 35 and 40 stalls. Some said they would not have entertained the idea of taking a share if they had known how many stalls there were going to be. Tire case will be resumed next Thursday.
