PROTECTION FOR BED AND BREAKFAST TENANTS

WELLINGTON, March 10. “It has come under my notice that certain press statements, made recently, imply that no protection is afforded under the Tenancy Act, to those persons occupying accommodation in boarding houses where ‘morning tray and’ is served.” said the Minister of Labour, Mr A. McLagan, today. “This is totally incorrect. Under the Tenancy Act, where any person, or two or more persons, are jointly or severally granted the right to occupy, for residential purposes, any part of a building, whether oi- not those persons are provided with services by the landlord, and have, with other persons, the right to the use in common or any other part of the building, the premises occupied are deemed to be let to" that person, or those persons, as a separate dwelling; and where several amounts are payable by two.or more persons, the total of the amounts paid is deemed to be the rent of the premises. “It is also provided that, where a landlord supplies any meals or food, the premises come within the provisions of the Act, if the value of the meals or food, or cost of same to the landlord (which ever is the less) does not form a substantial proportion of the amount payable by the tenant to the landlord as rent. From the above, it will be noted that the Act covers those persons in apartment houses, whether they are obliged to share rooms with other persons, or not, and also where the cost of food supplied by ®he landlord does not amount to a substantial proportion of the rent payable. ' “In cases where tenants feel they are paying an excessive amount lor such a type of accommodation, they have a remedy under the Act, and they may either consult their own solicitor, or seek the advice of a Rents Officer attached to the nearest office of the Department of Labour and Employment, who will investigigate the position, and, on their instructions, will take . any necessary action to secure an adjustment.”
