I After an hour’s retirement late this I afternoon a. jury in the Supreme Court Xeh heard a claim for £5036 dam-I ages for the widow and eight children, of a man killed in a motor-car col- ■ lision near Te Horo in March, returned with a verdict in plaintiff’s favour, fixing damages at £3029. Responsibility for the accident was placed on the driver of the car in which plain-: tiff’s husband was travelling, though the driver and owner of the car with which it collided also were named as, defendants. The hearing began the’ previous day. I The plaintiff was Bernadme Maud Roach, of Otaki, widow of William Hakaraia Roach, a carpenter, of Otaki. and the defendants were Daniel George Fraser, licensee of the New Central Hotel. Petone (in whose car Roach I was travelling when he suffered tatul injuries). Ronald Graeme Guy. a ien-| tai car proprietor (who had rented! the car with which Fraser’s car col-1 tided), and ’Whin Carroll, a farmer., of Hastings, driver of Guy’s car. j Mrs. Roach alleged that either Fraser or Carroll or both had been negligent as drivers, and that Guy had not maintained the lights of his car in good order. Fraser denied negligence, and said the collision was caused entirely bv the negligence of either Guy or Carroll, or both. Guy and Carroll said the cause of the collision was the negligence of Fraser, and denied the allegation of negligence against | themselves. .jndgmeni was entered against eraser with plaintiff's costs, and judgment was entered for the successful defendants for costs against the plaintiff, and an order was made for the recovery of those costs by the plaintiff from F r a ser.
