LONDON, April 25

Evidence of a bankrupt having lived at the rate of £l,OOO to £1,400 a year was given yesterday before Mr. Justice H’iiiery in the King’s Bench Division.

Mrs. Iris Shashoua. of Kingsleycolirt, Willesden Green, N.W.. widow of Abraham Shashoua. general merchant, claimed damages for herself and her 10-years.old son in respect of li .r/husband's death following injuries in a road accident.

She sued Mr. Vy.sc Millard, of the Mill Stream, Amersham, Bucks, whose car knocked Mr. Shashoua down as he was crossing the road from another car to inquire the way. Contributory negligence was pleaded for the defence.

raid that Mr. Shashoua was an undischarged bankrupt. Mrs. Shashoua had since been a party to an action in which judgment for £6OO was pleaded against her. Although Mr. Shashoua was an undischaiged bankrupt, counsel went on, he and his wife were living at the nite of £l.OOO to £ 1.400 a year. Mr. Justice Hilbery: Well, that do.-:- not. surprise me. What were his creditors going to get? Mr. Rawlins: 1 am instructed, about I’d in the pound. Counsel said that Mr. Shashoua gave his wife £lO a week for household expenses and another £5 a month. Ho also gave her a personal allowance of £4 a week. Recreations and theatres cost them £2 a week, and usually they went for holidays abroad, which cost them about. £l5O a year.

Mr. Justice Hilbery: All this, and nothing for the creditors but lid in the pound! Replying to Mr. Fox-Andrews (for the defence), Mrs. Shashoua said that at the time of her husband’s death they were living at the rate of £25 to £3O a week. Mr. Fox-Andrews: Do you know that lie never paid income-tax’? —No, 1 don’t know anything about his business details.

Mr. Justice Hilbery gave judgment for £9OO, with costs, and apportioned £5OO of the award to, Mrs. Shashoua and £4OO to her son. A stay of execution with a view to an appeal was granted.
