AN UNUSUAL CLAIM. [l*EB PBESS ASSOCIATION.] DUNEDIN, September 3. An unusual case before Mr Justice Kennedy, in the Supreme Court this morning was au application by Alfred Emanuel Smith to have his name removed from the register of shareholders of Hattons Confectionery Co. in respect to 500 shares, the applicant claiming that he had been allotted 1500 shares instead of 1000 applied for. ( Counsel said that no scrip had been received by Smith, but he had a receipt for £lOOO for 1000 shares. There was no acquiescence by the applicant in respect to the other 500 shares. Counsel added that the matter was not contested. Efforts had been made by solicitors to obtain access to the share register of the company, but this was not available. One director, counsel said, had denied that he was such, and the secretary denied that he held that position. In the meantime the bank had put in the receiver. In reply to His Honor, counsel said that he had a list of shareholders, which showed that the largest holder was Oswald M. Smith. He had paid only 2/- per share on 9423 shares, while the applicant had fully paid up for 1000 shares. His Honor ordered that the register of members bo rectified by the removal of -applicant’s name as> the holder of 500 shares, leaving him registered as the holder of 1000 fullypaid shares.
