ESCAPEE’S REQUEST REFUSED.

AUCKLAND, November 1.

A request that he be flogged instead of forfeiting any remission of the sentence he is now seiwing, was made by Charles Hayward, who with Harris O’Neill, was brought before Mr Justice Smith to-day, for sentence, for escaping from Mount Eden gaol, and stealing clothing. The Judge said he must impose a thoroughly deterrent sentence. O’Neill would be sentenced to three years’ hard labour, and Hayward to two years’, to be served after their present sentences.

Hayward: I have lost any remission of my present sentence through this act. If it lies in your power, your Honor, I would sooner take a flogging, and leave the sentence as it is.

His Honor: No, I cannot do that.
