WAIHEMO’S BOATSWAIN
DAMAGE CLAIM FAILS. [PEP. PRESS ASSOCIATION.] WELLINGTON, July 3. Judgment for defendants -was given by Mr. Page, S.M., to-day, in the case in which John Brown, seaman, proceeded against the Federated . Seamen’s Union, F. P. Walsh, President of the Union, and twelve members, of the crew of the Waihemo, claiming £250 damages, on consequence of the alleged conspiracy to deprive him of employment as boatswain of the vessel. The Magistrate said it was plain that plaintiff’s methods of handling men created considerable unrest among them, and this was substantial cause for their refusing to sail with him. “In my view,” he said, “these seamen, finding harmonious working under plaintiff impracticable, had reasonable grounds for refusing to sail with him as boatswain. Their action in so refusing was not wanton, or malice, or done for any ulterior motive, and in my opinion, does not give rise to an action against them.” There was no cause, he said, for connecting the Union or the President with the case.
