DR PEACOCK'S TRIAL.

NEW TRIAL ORDERED

CONVICTION QUASHED

FIB PBBBB ABBOCIATTOSr—OOFYBIOHT.J

SYDNEY, Dec. 8

The High Court quashed the conviction of Dr. Peacock for the murder of the girl Davies. The Chief Justice found that, although there was sufficient circ.imstpntial evidence to show that Davies was dead, it was insufficient to connect Dr. Peacock, there being no corroboration of the evidence of Poke, who was an accomplice. At the trial the Judge should have directed the jury that there was no corroboration of Poke*3 evidence, therefore it was ous to convict as he had done and he must return a verdict of not guilty, therefore he had not granted a new trial. Mr. Justice Barton agreed with the quashing of the conviction but considered there should be a new trial. Mr. Justice O'Connor agreed there should be a new trial in the Peacock The High Court ordered a new trial.
