KUMARA MAGISTRATES COURT

WEDNESDAY, FEB. 21, v (Before R. Achcson, Esq., S. M.). Police v. James McEwan, charged* with damaging the windows of the’ Forresterii Hall to an amount less than £6. Mr Byrne appeared for plaintiff, who pleaded guilty. Mr Byrne asked for a lenient sentence as it was the first time accused was charged before the Court, and he was the only support of a widowed mother and family. His Worship said that the offence was a serious one, and fined him £5 or £wo months imprisonment. A week was allowed in which 10 pay the fine i' Michjiel Mclnerey v. Isabella Cunningham, claim £4 18s damages on account of defendant’s sheep trespassing on his land. Mr Murdoch for plaintiff, Mr Byrne for defendant. At the outset Mr Byrne said that he could, prove positively that the sheep in question did not belong to defendant, and asked tor a - -noil-suit His Worship however, decided to healr the evidence. The evidence of plaintiff, Daniel White, and John Kelly was given in support of the claim and proof the*trespass. Robert Cunningham swore in . defence that he and his brother John were the owners of the sheep. Mr Murdoch claimed that Mrs Cunningham was bailee. > His Worship ruled against the contention, and granted a nonsuit, with costs avid solicitor’s fee £1 Is.
