The validity of the Gillies Air Admission Patents has recently b,epn Remonstrated in the Supreme Court in Dunedin by His Honour Sir Joshua Stirange Williams, granting .an injunction against Alexander Smaill, jun., preventing him from using the Gillies Patent on the "Smaill Milking Machine. The following is an extract of the finding of tihe Court:— "This Court doth adjudge and order that an injunction be awarded restraining the- Defendants and each and every of them their and each of their respective servants agents and workmen during the continuance of the Letters Patent granted to the Plaintiff and any extension of the term thereof from using or exercising or causing or permitting to be used and exercised the invention described in. the speeilicatioii and drawings filed ■with the said Letters Patent and from manufacturing selling letting for hire disposing or making any profitable use or promoting or being engaged or interested in the manufacture sale letting for hire disposal or profitable use of any pneumatic milking* apparatus not made by the plaintiff or his licensees and having anplied thereto the principle of air admission in the manner described and for the purposes mentioned in the said specification or so constructed as to allow of air admission for the purposes of facilitating the travel of the milk from the cow to the receiver or differing from such pneumatic milking apparatus only colorably and by the substitution of mere mechanical equivalents or from in any manner infringing the rights and privileges granted to the plaintiff by the said Letters Patent. And further that the Defendant Alexander Smaill the Younger to deliver up on oath to the PlaintifFor destroy or otherwise render unfit for use all pneumatic milking apparatus manufactured or let for hire by or by the order or for the use of the said Defendant in infringement/of the'said Letters Patent as aforesaid which are' in the possession' custody or powey of the said Defendant or of h\& or agents or under his or their cantroll." ■ ■ . ; The foregoing proves conclusively that the Gillies Air Admission Patent as , supplied to the L.K.G.
