Thursday. (Before Mr A. D. Thompson, SM.) Waugh v. Pitts— Mr Carty for informant. The defendant was charged with assaultat Kimbolton on the 28rd of December last. Alter bearing the evidence of the informant, witness Boohing and the defendant, the defendant was convicted and fined 10j, witnesses expenses ss, and solicitor £1 10s. Hart v. Thompson Bros. —Mr Carty for the plaintiff and Mr McIntyre for the defendant. The plaintiff claimed the sum of £10 for commission on the sale of a property at Utuwai to C. F. Hart. The instructions to sell were admitted, but for the defence it was set up that the property in the meantime had been bought solely by one of the defendants and that he sold direct to C. F. Hart. The Magistrate held that plaintiff was authorised to sell and did bring about the sale and ! gave judgment, for the amount , claimed with oosts of court 15s, i witnesses expenses £8, and solicitor's fee £1 6s.
