Levien, S.M.. on a charge of dangerous driving on the Great South Hoad on January 13 and va? convicted for failing to keep as far to the left as possible and fined £2 lOs and costs. Defendant conducted his own defence. Inspector N. G. Davenport said that at 7.30 p.m. on the day in question lie was in bis car at Mercer in company with Constable F. T. "Wakelin when a service car driver complained of the erratic driving of a small car which was then outside the Mercer hotel. When the car moved off witness said he followed it. The car was driven in a reasonable manner until Pokeno was passed when it beuan to sway from one side of the road i Die other. The ear was stopped on tire Bombay deviation. Constable F. T. Wakelin gave corroborative evidence and said that he talked with the defendant in the Mercer hotel and after the car was stopped on the deviation took Delgrosso 1 ' tlie Pukekohe police station at his own request where he was examined by Sergeant T. Kelly. He considered that though lie had been drinking defendant could not he proved to he until to have charge of the vehicle. Defendant pleaded that the otfenoe was due to excessively heavy rain. The magistrate gave his decision as already stated.
