In the action Jane S. Grierson versus Arthur Cleave for a decree directing Cleave to substantially perform a contract to sell or buy from her 2000 fully paid-up shares in the Wairakei, Ltd., within two years after allotment by the, company of 70,000 shares, His Honour Mr Justice Stringer held that 70,000 shares bad been allotted, . and’ gave judgment in favour of the plaintiff.
